Terms of Service

Please read these terms carefully before using oMyPDF. By using our Service you agree to be bound by them.

1. Acceptance of Terms

By accessing or using omypdf.comand its associated tools and services (collectively, the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

oMyPDF provides free, online PDF tools including merging, splitting, compressing, converting, signing, protecting, and other operations on PDF documents. Some tools operate entirely within your web browser; others use our servers for processing heavy files or operations that require server-side libraries.

We reserve the right to add, modify, suspend, or discontinue any feature of the Service at any time without notice.

3. Acceptable Use

You agree not to use the Service to:

  • Upload, process, or distribute files that contain malware, viruses, ransomware, or other malicious code.
  • Process content that infringes any copyright, trademark, patent, trade secret, or other intellectual property right of any person or entity.
  • Process content that is unlawful, defamatory, obscene, pornographic, invasive of privacy, or harassing.
  • Conduct automated, scripted, or bulk file processing without our prior written authorisation.
  • Probe, scan, or test the vulnerability of our systems; circumvent any security, authentication, or access-control measures.
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service.
  • Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks.
  • Resell, sublicense, or provide access to the Service to third parties as a commercial service without a separate written agreement with us.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right, at our sole discretion, to suspend or permanently terminate your access to the Service for any violation of these Terms, without prior notice and without liability to you.

4. User Content & Files

Your Ownership

You retain all intellectual property rights in the files and content you upload to the Service (“User Content”). These Terms do not transfer any ownership of your User Content to us.

Licence to Process

By uploading User Content, you grant us a limited, non-exclusive, royalty-free, worldwide licence to transmit, store, and process your User Content solely to perform the requested operation. This licence terminates automatically when your files are deleted (within 1 hour of processing).

Your Representations

You represent and warrant that:

  • You own, or have the legal right to use and process, all files you upload.
  • Your User Content does not infringe any third-party intellectual property, privacy, publicity, or other rights.
  • Your use of the Service, including the files you upload, complies with all applicable laws and regulations.

5. File Handling & Deletion

Files submitted to our servers are stored in a secure, isolated temporary directory and are automatically and permanently deleted within 1 hour of the completed operation. We do not back up, archive, or retain user files beyond this window. Download links expire after 1 hour.

Files processed entirely within your browser are never transmitted to our servers and are not retained by us in any form.

You are solely responsible for maintaining your own copies of the files you upload and the processed results you download. We are not responsible for any loss of data, file corruption, or failure to download results before the expiry of the 1-hour window.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR FREE FROM ERRORS OR DEFECTS.
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY RESULT OR OUTPUT.
  • WARRANTIES THAT ANY DEFECTS WILL BE CORRECTED.
  • WARRANTIES REGARDING THE INTEGRITY, SAFETY, OR VIRUS-FREE NATURE OF FILES PROCESSED THROUGH THE SERVICE.

USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SERVICE AND THE RESULTS OF THAT USE.

7. Limitation of Liability

This section limits our liability to you. Please read it carefully.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OMYPDF, ITS OWNERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, PARTNERS, SUPPLIERS, OR LICENSORS (“THE OMYPDF PARTIES”) BE LIABLE TO YOU FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND.
  • LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, ANTICIPATED SAVINGS, OR OTHER ECONOMIC ADVANTAGE.
  • LOSS, CORRUPTION, OR UNAUTHORISED ACCESS TO YOUR FILES OR DATA.
  • INABILITY TO USE THE SERVICE OR ANY INTERRUPTION, SUSPENSION, OR TERMINATION THEREOF.
  • ERRORS, INACCURACIES, OR DEFECTS IN ANY OUTPUT PRODUCED BY THE SERVICE.
  • DAMAGE TO YOUR DEVICES, SYSTEMS, OR OTHER PROPERTY ARISING FROM USE OF THE SERVICE.
  • UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.
  • ACTIONS OR CONDUCT OF ANY THIRD PARTY IN CONNECTION WITH THE SERVICE.

THE FOREGOING LIMITATIONS APPLY WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE OMYPDF PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

TO THE EXTENT LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, THE MAXIMUM AGGREGATE LIABILITY OF THE OMYPDF PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (i) THE TOTAL AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM, OR (ii) USD $10.00.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. IN THOSE JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

8. Indemnification

You agree to defend, indemnify, and hold harmless the oMyPDF Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your access to or use of the Service.
  • Your violation of these Terms.
  • Your User Content, including any allegation that it infringes a third party's rights.
  • Your violation of any applicable law, regulation, or third-party right.

We reserve the right to assume exclusive control of any matter subject to indemnification by you, at your expense. You agree to cooperate with our defence of such claims.

9. Intellectual Property

The oMyPDF name, logo, website design, user interface elements, and underlying software (“Our Content”) are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of Our Content to you.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of Our Content without our prior express written permission, except as permitted by law or as necessary to access and use the Service as intended.

10. Third-Party Links and Services

The Service may contain links to third-party websites or services. These links are provided for your convenience only. We have no control over, and assume no responsibility for, the content, privacy practices, or availability of any third-party websites or services. Accessing third-party links is entirely at your own risk.

11. Modifications to the Service and Terms

We reserve the right to modify, suspend, or permanently discontinue the Service (or any part of it), with or without notice, at any time. We will not be liable to you or to any third party for any modification, suspension, or discontinuation.

We may revise these Terms at any time by posting the updated version with a revised “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved in the courts of competent jurisdiction.

If you are a consumer located in the European Union, you may also have the benefit of any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

13. Paid Plans, Billing & Refunds

oMyPDF is free to use. We also offer optional paid plans (currently Plus and Pro) billed as recurring monthly or yearly subscriptions, in advance, through our third-party payment processor. Paid subscriptions renew automatically at the then-current price until cancelled, and you may cancel at any time; your plan stays active until the end of the period you have already paid for.

Subscription payments are generally non-refundable except where required by law or as set out in our Refund Policy, which also explains when you may be eligible for a refund (such as duplicate charges, persistent unresolved technical faults, or unauthorised charges) and how to request one. Please read the full Refund Policy, which forms part of these Terms. Nothing in these Terms limits any non-waivable statutory consumer rights you may have.

14. Miscellaneous

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. A waiver of any default is not a waiver of any subsequent default.

Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy and Cookie Policy, constitute the entire agreement between you and oMyPDF with respect to the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
